1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "User," "Student," "Recruiter," or "Faculty") and GrowGrader ("Company," "we," "us," or "our"), concerning your access to and use of the https://growgrader.in website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site" or "Platform").

By accessing the Platform, you agree that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Platform Description & AI Disclaimers

GrowGrader is an AI-driven recruitment and placement preparation platform. The Platform utilizes advanced artificial intelligence (specifically Google Gemini models) to dynamically generate tasks, evaluate code submissions, and assign employability scores.

We reserve the right to modify, update, or discontinue the Platform (or any part thereof) without notice at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Platform.

3. Account Registration & Security

To use certain features of the Platform, you must register for an account. You agree to:

• Provide true, accurate, current, and complete information during registration.
• Maintain and promptly update your registration data.
• Keep your password confidential and be responsible for all use of your account.
• Immediately notify us of any unauthorized use of your password or account.

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. B2B Subscriptions & Payments

Recruiter and Faculty accounts require an active, paid annual subscription to access the hiring and task management dashboards.

• Fees: The annual subscription fee is ₹75,000 (INR), subject to change.
• Billing: All payments are processed securely via Instamojo. By providing payment information, you authorize us to charge the designated payment method.
• Auto-Renewal: Subscriptions do not automatically renew unless explicitly stated at checkout. You will receive renewal reminders 30 days prior to expiration.
• Taxes: All fees are exclusive of applicable taxes unless stated otherwise. You are responsible for all applicable taxes.

5. Anti-Cheat & Academic Integrity

GrowGrader employs stringent anti-cheat mechanisms to ensure the integrity of the hiring process.

By submitting tasks on the Platform, Students explicitly consent to automated monitoring, which may include but is not limited to:

• Plagiarism detection against internet sources and other student submissions.
• AI-assisted code generation detection.
• Browser tab monitoring and copy-paste detection during timed assessments.

Violation Policy: If our systems or a Faculty/Recruiter determines that a Student has violated academic integrity policies, GrowGrader reserves the right to immediately suspend the Student's account, nullify their employability score, and notify associated universities or recruiters without liability.

6. Intellectual Property Rights

Unless otherwise indicated, the Platform is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Platform (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

User Submissions: By submitting code, text, or any other content ("Submissions") to the Platform, you grant GrowGrader a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, evaluate (via AI), and display such Submissions for the sole purpose of operating and improving the Platform.

7. Prohibited Activities

You may not access or use the Platform for any purpose other than that for which we make the Platform available. As a user of the Platform, you agree not to:

• Systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform.
• Attempt to reverse engineer, decompile, or extract the source code of the GrowGrader platform or its AI integrations.
• Use the Platform in a manner inconsistent with any applicable laws or regulations.
• Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Platform.

8. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.

9. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your Submissions; (2) use of the Platform; (3) breach of these Terms; (4) any breach of your representations and warranties set forth in these Terms; or (5) your violation of the rights of a third party, including but not limited to intellectual property rights.
